شرایط و قوانین حمل و نقل

بسته‌بندی  1. Packaging /

The Sender is solely responsible for ensuring that the parcel is properly, securely and adequately packed in accordance with standard packaging requirements to prevent any damage during transit.

فرستنده به تنهایی مسئول بسته‌بندی اصولی، ایمن و استاندارد مرسوله مطابق با الزامات بسته‌بندی متعارف جهت جلوگیری از هرگونه آسیب در طول مسیر حمل می‌باشد.

اقلام ممنوعه  2. Prohibited Items /

The transportation of illegal, hazardous, flammable, explosive, perishable goods, narcotics, or any items requiring special permits is strictly prohibited. The Courier reserves the right to refuse, return, or dispose of such items at the Sender’s sole expense.

حمل و نقل کالاهای غیرقانونی، خطرناک، قابل اشتعال، منفجره، فاسدشدنی، مواد مخدر و هرگونه اقلامی که نیازمند مجوز خاص باشند، اکیداً ممنوع است. کوریر حق دارد چنین محموله‌هایی را رد، عودت یا با هزینه فرستنده امحا نماید.

حق بازرسی  3. Right to Inspect /

The Courier reserves the right to inspect the contents of any parcel at any time in order to verify compliance with applicable shipping regulations and safety standards.

کوریر این حق را برای خود محفوظ می‌دارد که در هر زمان محتوای مرسوله را جهت اطمینان از رعایت مقررات حمل و نقل و استانداردهای ایمنی مورد بازرسی قرار دهد.

ارزش اعلامی و مسئولیت  4. Declared Value and Liability /

The maximum liability of the Courier in the event of loss or damage shall be limited to the Declared Value stated on the waybill. In the absence of a declared value, compensation shall be calculated on the basis of the Company’s Tariff Schedule then in effect (published at the Company’s offices and official website), or such other limit as may be applicable under international conventions for air carriage, if relevant. Intrinsic value, sentimental value and any indirect or consequential damages (including loss of profit) shall not be compensated.

حداکثر مسئولیت کوریر در صورت مفقودی یا آسیب‌دیدگی مرسوله، محدود به «ارزش اعلام‌شده» در بارنامه می‌باشد. در صورت عدم اعلام ارزش، خسارت بر اساس «تعرفه‌نامه» جاری شرکت (که در دفاتر شرکت و وب‌سایت رسمی آن منتشر می‌شود) یا در حمل هوایی بین‌المللی طبق سقف‌های متعارف کنوانسیون‌های مربوطه محاسبه خواهد شد. ارزش ذاتی، ارزش معنوی و هرگونه خسارت غیرمستقیم یا تبعی (از جمله عدم‌النفع) قابل جبران نمی‌باشد.

اقلام شکستنی  5. Fragile Items /

Fragile items (including but not limited to glass, ceramics, and electronic equipment) must be clearly marked as such and packed with adequate shock-absorbing materials. The Courier shall bear no liability for damage to fragile items arising from inadequate packaging by the Sender.

اقلام شکستنی (از جمله شیشه، سرامیک و تجهیزات الکترونیکی) باید به وضوح علامت‌گذاری شده و با مواد ضربه‌گیر مناسب بسته‌بندی گردند. کوریر در قبال آسیب‌دیدگی اقلام شکستنی ناشی از بسته‌بندی غیراصولی توسط فرستنده هیچ‌گونه مسئولیتی ندارد.

قوه قاهره  6. Force Majeure /

The Courier shall not be liable for any delay, loss or damage caused by force majeure events, including but not limited to natural disasters, severe weather conditions, accidents, strikes, riots, governmental actions or any other circumstances beyond the reasonable control of the Courier.

کوریر در قبال هرگونه تأخیر، مفقودی یا آسیب ناشی از قوه قاهره، از جمله (اما نه محدود به) حوادث طبیعی، شرایط جوی نامساعد، سوانح، اعتصابات، اغتشاشات، اقدامات دولتی یا هر شرایط دیگری خارج از کنترل معقول کوریر، هیچ‌گونه مسئولیتی نخواهد داشت.

دقت آدرس  7. Address Accuracy /

The Sender undertakes to provide accurate and complete recipient details, including full address, postal code, and contact telephone number. Any additional costs arising from incorrect or incomplete information shall be borne exclusively by the Sender.

فرستنده متعهد است اطلاعات دقیق و کامل گیرنده شامل آدرس کامل، کد پستی و شماره تماس را ارائه نماید. هرگونه هزینه اضافی ناشی از نادرست یا ناقص بودن اطلاعات صرفاً بر عهده فرستنده خواهد بود.

زمان تحویل  8. Delivery Times /

Stated delivery times are estimates only and are not guaranteed, unless a specific express service with a confirmed time commitment has been purchased. The Courier will normally make up to three (3) delivery attempts without additional charge. If delivery remains unsuccessful, a notice will be left and the shipment may be returned to the Sender at the Sender’s expense.

زمان‌های اعلام‌شده تحویل صرفاً تقریبی بوده و ضمانت‌شده نمی‌باشند، مگر آنکه سرویس اکسپرس خاصی با تعهد زمانی مشخص خریداری شده باشد. کوریر معمولاً تا سه (۳) بار بدون دریافت هزینه اضافی برای تحویل تلاش می‌کند. در صورت عدم موفقیت، یادداشتی گذاشته شده و مرسوله ممکن است با هزینه فرستنده به مبدأ عودت داده شود.

محموله‌های غیرقابل تحویل  9. Undeliverable Shipments /

In the event that the recipient refuses the parcel, is unavailable, or the address is incorrect, the Courier may attempt redelivery or return the shipment to the Sender. All related costs, including storage, redelivery, and return charges, shall be borne by the Sender.

در صورتی که گیرنده مرسوله را تحویل نگیرد، در دسترس نباشد یا آدرس نادرست باشد، کوریر می‌تواند نسبت به تحویل مجدد           یا عودت مرسوله به فرستنده اقدام نماید. کلیه هزینه‌های مربوطه از جمله انبارداری، تحویل مجدد و عودت، بر عهده فرستنده است.

بیمه اختیاری  10. Optional Insurance /

The Sender may request additional insurance coverage for higher-value shipments upon payment of the applicable premium. In the absence of such insurance, the Courier’s liability shall remain limited as set forth in Clause 4.

فرستنده می‌تواند با پرداخت حق بیمه مربوطه، پوشش بیمه‌ای اضافی برای مرسوله‌های با ارزش بالاتر درخواست نماید. در صورت عدم درخواست بیمه، مسئولیت کوریر محدود به مفاد بند ۴ خواهد بود.

وزن و ابعاد  11. Weight and Dimensions /

All shipments must comply with the maximum weight and dimension limits published by the Courier from time to time (typically up to 70 kg and maximum length of approximately 270 cm for express parcels, subject to change). Freight charges shall be calculated on the basis of the greater of the actual weight or the volumetric weight. The volumetric weight is calculated using the following formula: Volumetric Weight (kg) = (Length × Width × Height in centimeters) ÷ 5000. Overweight or oversized parcels may be refused or subject to additional charges.

کلیه مرسوله‌ها باید با محدودیت‌های حداکثر وزن و ابعاد اعلام‌شده توسط کوریر مطابقت داشته باشند (معمولاً حداکثر ۷۰ کیلوگرم و طول تقریبی ۲۷۰ سانتی‌متر برای بسته‌های اکسپرس، قابل تغییر). کرایه حمل بر اساس وزن واقعی یا وزن حجمی (هر کدام بیشتر باشد) محاسبه می‌گردد. وزن حجمی طبق فرمول زیر محاسبه می‌شود: وزن حجمی (کیلوگرم) = (طول × عرض × ارتفاع بر حسب سانتی‌متر) ÷ ۵۰۰۰. محموله‌های سنگین‌تر یا بزرگ‌تر از حد مجاز ممکن است رد شده یا مشمول هزینه اضافی گردند.

هزینه‌های جانبی و اضافه‌بها  12. Additional Charges and Surcharges /

The Courier may levy additional charges including but not limited to fuel surcharge, remote area surcharge, clearance service fees, residential delivery fees and any other applicable surcharges as published in the Company’s Tariff Schedule from time to time.

کوریر می‌تواند هزینه‌های جانبی از جمله (اما نه محدود به) اضافه‌بهای سوخت، هزینه مناطق دورافتاده، هزینه خدمات ترخیص، هزینه تحویل مسکونی و سایر هزینه‌های اعلام‌شده در تعرفه‌نامه شرکت را اعمال نماید.

حق امتناع از پذیرش  13. Right to Refuse /

The Courier reserves the right to refuse acceptance of any shipment that violates these Terms and Conditions, poses a legal, safety, or operational risk, or for other reasonable commercial grounds, without being obliged to provide a detailed justification.

کوریر حق دارد بنا به دلایل معقول تجاری یا در صورتی که مرسوله ناقض این شرایط و قوانین باشد یا ریسک قانونی، ایمنی یا عملیاتی داشته باشد، بدون الزام به ارائه توضیح تفصیلی، از پذیرش آن خودداری نماید.

نحوه طرح ادعا و دریافت خسارت  14. Claims Process /

Any claim in respect of damage or shortage must be submitted in writing within fourteen (14) working days, and any claim in respect of loss within thirty (30) working days, from the date of delivery (or the expected delivery date), accompanied by the original waybill and supporting documentation, submitted through the channels specified in Clause 22 (Notices). Claims submitted after these periods shall not be entertained.

هرگونه ادعا در خصوص آسیب یا کسری باید حداکثر ظرف چهارده (۱۴) روز کاری و ادعا در خصوص مفقودی حداکثر ظرف           سی (۳۰) روز کاری از تاریخ تحویل (یا تاریخ مورد انتظار تحویل)، به صورت کتبی و همراه با اصل بارنامه و مستندات مربوطه              و از طریق کانال‌های مذکور در بند ۲۲ (اطلاع‌رسانی و ابلاغ) ارائه گردد. ادعاهای مطرح‌شده پس از این مهلت‌ها قابل رسیدگی نخواهند بود.

ضمانت بازگشت وجه (در صورت اعمال)  15. Money-Back Guarantee (where applicable) /

For certain premium express services specifically designated by the Company, a money-back guarantee may apply in the event of service failure (delay beyond the committed time). Such guarantee is subject to the specific terms published for that service and does not apply to standard services.

برای برخی سرویس‌های اکسپرس ویژه که توسط شرکت مشخص شده‌اند، در صورت تأخیر فراتر از زمان تعهدشده، ضمانت بازگشت وجه ممکن است اعمال شود. این ضمانت تابع شرایط خاص اعلام‌شده برای آن سرویس بوده و شامل خدمات عادی نمی‌شود.

گمرک، عوارض و مقررات بین‌المللی  16. Customs, Duties and International Regulations /

For international shipments, the Sender is solely responsible for the accurate and complete declaration of the contents, value, quantity and applicable tariff code of the parcel, as well as for compliance with all export and import regulations of the countries of origin and destination. All customs duties, taxes, value-added tax, clearance fees and related charges imposed by the customs authorities of the destination country shall be the responsibility of the Recipient (unless Delivery Duty Paid service has been selected). The Courier shall not be liable for any delays, seizures, returns or destruction of the shipment resulting from customs inspection, incorrect declaration or non-compliance with applicable regulations. In the event that the Recipient fails to pay the applicable duties and taxes, or the shipment remains uncleared beyond the permitted period, the Courier may return the shipment to the Sender at the Sender’s expense or, where permitted by law, dispose of it. The Sender warrants that the shipment does not contain any items prohibited under the laws of the Islamic Republic of Iran, the destination country or applicable international conventions.

در مرسولات بین‌المللی، فرستنده به تنهایی مسئول اظهار دقیق و کامل محتویات، ارزش، تعداد و کد تعرفه مرسوله و همچنین رعایت کلیه مقررات صادرات و واردات کشورهای مبدأ و مقصد می‌باشد. کلیه حقوق گمرکی، عوارض، مالیات بر ارزش افزوده، هزینه‌های ترخیص و هزینه‌های مرتبط که توسط گمرک کشور مقصد اعمال گردد، بر عهده گیرنده است (مگر آنکه سرویس پرداخت عوارض توسط فرستنده انتخاب شده باشد). کوریر هیچ‌گونه مسئولیتی در قبال تأخیر، توقیف، عودت یا امحای مرسوله ناشی از بازرسی گمرکی، اظهار نادرست یا عدم رعایت مقررات ندارد. در صورتی که گیرنده از پرداخت عوارض و مالیات خودداری ورزد یا مرسوله بیش از مهلت مجاز در گمرک باقی بماند، کوریر می‌تواند مرسوله را با هزینه فرستنده به مبدأ عودت دهد یا در صورت مجاز بودن قانون،    آن را امحا نماید. فرستنده تضمین می‌کند که مرسوله فاقد هرگونه کالای ممنوعه طبق قوانین جمهوری اسلامی ایران، کشور مقصد      و کنوانسیون‌های بین‌المللی می‌باشد.

حفاظت از داده‌ها و حریم خصوصی  17. Data Protection and Privacy /

The Courier processes personal data of the Sender and Recipient solely for the purpose of providing the transportation services and in accordance with the Electronic Commerce Law of the Islamic Republic of Iran and other applicable data protection regulations. Personal data shall be retained only for the period necessary to perform the service and to comply with legal and regulatory obligations, and shall not be disclosed to third parties except as necessary for the performance of the service or as required by law.

کوریر داده‌های شخصی فرستنده و گیرنده را صرفاً به منظور ارائه خدمات حمل و نقل و مطابق با قانون تجارت الکترونیکی جمهوری اسلامی ایران و سایر مقررات مربوط به حفاظت از داده‌ها پردازش می‌کند. داده‌های شخصی صرفاً تا زمان لازم برای انجام خدمت         و ایفای تعهدات قانونی و مقرراتی نگهداری خواهند شد و جز در موارد ضروری برای انجام خدمت یا الزامات قانونی،                            در اختیار اشخاص ثالث قرار نخواهند گرفت.

قانون حاکم و مرجع حل اختلاف  18. Governing Law and Dispute Resolution /

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Islamic Republic of Iran. Any dispute arising out of or in connection with these Terms, including the carriage itself, shall be subject to the exclusive jurisdiction of the competent courts of the Islamic Republic of Iran, unless a different forum is expressly agreed in writing by both parties or is mandatorily required under an applicable international convention.

این شرایط و قوانین تابع قوانین جمهوری اسلامی ایران بوده و بر اساس آن تفسیر می‌گردد. هرگونه اختلاف ناشی از یا مرتبط                 با این شرایط، از جمله عملیات حمل، در صلاحیت انحصاری دادگاه‌های صالح جمهوری اسلامی ایران خواهد بود، مگر آنکه          مرجع دیگری صراحتاً و کتباً مورد توافق طرفین قرار گرفته باشد یا بر اساس کنوانسیون بین‌المللی لازم‌الاجرا، مرجع دیگری الزامی باشد.

زبان قرارداد و اولویت نسخه‌ها  19. Language of the Agreement /

These Terms and Conditions are issued in both English and Persian for the convenience of the parties. In the event of any discrepancy, inconsistency, or conflict between the two language versions, the Persian version shall prevail and shall be deemed the authoritative text for all legal purposes within the Islamic Republic of Iran.

این شرایط و قوانین جهت سهولت طرفین به دو زبان فارسی و انگلیسی تنظیم شده است. در صورت وجود هرگونه مغایرت، تناقض   یا اختلاف بین دو نسخه، متن فارسی معتبر و ملاک عمل برای کلیه مقاصد حقوقی در قلمرو جمهوری اسلامی ایران خواهد بود.

حق حبس مرسوله  20. Right of Lien /

The Courier shall have a general right of lien over any shipment in its possession in respect of any unpaid freight charges, duties, taxes, storage fees or other sums due from the Sender or Recipient, and may retain the shipment until such sums are paid in full.

کوریر نسبت به هر مرسوله‌ای که در تصرف دارد، در قبال هرگونه کرایه حمل، عوارض، مالیات، هزینه انبارداری یا سایر مطالبات پرداخت‌نشده از فرستنده یا گیرنده، دارای حق حبس عمومی است و می‌تواند تا زمان تسویه کامل این مطالبات، مرسوله را نزد خود    نگه دارد.

تفکیک‌پذیری مفاد قرارداد  21. Severability /

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed severed, and the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

چنانچه هر یک از مفاد این شرایط و قوانین به موجب قانون قابل اجرا، باطل، غیرقانونی یا غیرقابل اجرا تشخیص داده شود،            آن بند مجزا تلقی شده و اعتبار، قانونی بودن و قابلیت اجرای سایر مفاد به هیچ‌وجه خدشه‌دار نخواهد شد.

نحوه ابلاغ و اطلاع‌رسانی  22. Notices /

All notices, claims, and communications required under these Terms and Conditions shall be submitted in writing to the Courier’s registered office address, official customer-service email, or such other channel as the Courier may officially publish from time to time. Notices shall be deemed received on the date of confirmed delivery to the relevant channel.

کلیه اطلاعیه‌ها، ادعاها و مکاتبات موضوع این شرایط و قوانین باید به‌صورت کتبی و از طریق نشانی دفتر ثبت‌شده کوریر، ایمیل رسمی خدمات مشتریان یا سایر کانال‌هایی که کوریر رسماً اعلام می‌نماید، ارسال گردد. اطلاعیه‌ها در تاریخ تأیید دریافت توسط کانال مربوطه، ابلاغ‌شده تلقی می‌گردند.

قبول شرایط  23. Acceptance of Terms /

The handover of the parcel to the Courier and the signing of the waybill shall constitute full and unconditional acceptance of all the foregoing Terms and Conditions by both the Sender and the Recipient.

تحویل مرسوله به کوریر و امضای بارنامه به منزله قبول کامل و بلاشرط تمامی شرایط و قوانین فوق توسط فرستنده و گیرنده می‌باشد.
